I've been living at my apartment for about 8 months. The first 6 months were fine, then some new neighbors moved in.

In the last two months, I've been getting noise complaints through management even though my lifestyle has been completely quiet.

I recently got a notice saying to cure my noise complaint or breach contract and get evicted. This notice cited some banging noise I apparently made when I was spending the weekend at my hometown over 100 miles away.

I did a lot of research and a few people have had the same problem as me. And every response (by a land owner) that I got to this problem was: "It's probably best to move out."

So apparently I have no rights in this situation and there's nothing I can do but bend over and let my neighbors fuck me with their lies.

Sigh.

I'd file noise complaints on them tbh... not saying that's the best course of action, just what I'd do.

Tell them that these are false claims and that write a letter saying that the noise complaint received was when you were away from home. Then include some references to verify your claim.

I have been through a lot of problems in my lifetime, and I have not had a single one that could not be solved by smearing poo all over the place. Sometimes, a man's gotta do what a man's gotta do.

Or you could try filing complaints about your neighbor being too noisy as well, and maybe they'll get the idea. I would try the poo smearing first though.

Can anyone else testify against you?

Considering you have actually been away and you can prove it, there shouldn't be a strong case against you. Try to talk to your manager maybe, or your neighbors if you haven't.

Dunno, whole situation feels weird.

Well now that they've played their cards, I have a few things I can do.

1) The landlord offered me another unit in the same complex. I can just hire some people to move me. I'm making a comfortable living so the monetary loss, while painful, won't really affect me at all. All it costs me is a headache.

2) Interestingly, landowners can't actually evict people, they have to go to the courts to do it. So I could build my case and hope the court sides in my favor. This is probably the just route, and the one where I can keep my pride, but it can potentially cost me thousands and an even bigger headache.

3) Smear shit all over everything, probably end up evicted and in jail. It'll be almost impossible to find another apartment.

Sounds really weird. Do you have documentation you were out of town that weekend like credit card statements? A few noise complaints and they threaten eviction without prior warnings? Can you invite the management to come over next time there is a complaint?

I'd say I was willing to move if the landlord covered the cost, but maintain that you've done nothing wrong.
It's supposed to be automatic but actually you have to press this button.

I'd just get proof you weren't there phone the landlord up explain him offer the proof. He should be able to see you're doing nothing wrong. The other unit would be a good sollution too. But YOU shouldn't be the one needing to move.

What... How can there be NOTHING you can do when someone is filing false noise complaints. That is unbelieveable. If you are actually innocent then just dont take it in the ass. Don't they need proof before they can even file a noise complaint. If they are just leaving notes on your door then ignore it until cops show up and explain to them that you actually aren't making noise.

You should go to your other neighbours and ask them if they have been complained about by these neighbours. Then go to the landlady together and bring up the issue about these sound sensitive neighbours.

Otherwise fuck em and just move to another apt. Win or lose I wouldn't want to live besides people like that.

Reexamine the wording of your contract to make sure you have a tenable defense. Depending on the wording, you could be responsible for noise pollution regardless of your presence in the premises, making your trip to your hometown completely irrelevant to the validity of their complaints.

In whatever case, make your case first with management and find out whether evidence or logic even factors into their interpretations of noise complaints. I hope you have a silver tongue. You haven't shown any reason for them to take you to court, but if they do, their entire case is built on your neighbors' testimony. However, if the wording of your contract is such that management can hold you in breach for being targeted by complaints at all, you have no legal recourse if they decide to do so. Don't sign such silly documents. Easier said than done.

i think it's just one neighbor. Not sure. And there've been multiple noise complaints. I've been compliant the whole time and am very careful of any noise output coming from my end. There is virtually none anymore.

Hmm I'm going to finally get to talk to the apt manager tomorrow so I guess I'll see what exactly is going on when i do.

I believe that the last post by Souma is on the mark. Best get out, as it could be someone was in the apartment when you were out and the neighbors are not telling (side deals), or management just wants you out because they are compromised by one of the renters and may be involved in this mess as well. As much as it hurts, it will be far better emotionally and you will be far safer if you move now. Send a notoraized letter stateing that you were not there that weekend. Mail it AFTER you leave. Send one to the police as well, the apartment association and keep one for yourself.

The important thing is to Get the He-- Out! Nothing Good is coming if you stay, and leave the entire complex.
