Is the order still active? they may have refunded that 45 dollars back to you because they realized the mistake in pricing and now probably pulled the order out?

Yeah. I know that is the reason they refunded.
I am wondering if that is even legal because I have paid and ordered correctly.
There was no mistake on my part and they did not give me any notice or explanation.

Well, I'm not a lawyer, but the first thing I would do is go back to the website and read the fine print on the contract they make you agree to when you place your order. If they say that the order is final and binding once you send through your payment, then perhaps you have a case.

Do you have some kind of e-mail confirmation of the order?

Ya, somewhere along the lines of that websites User Agreements, it probably states they can change/remove orders without notice. But this completely depends if they do say sales being allowed to change,although trying to pursue a legal case or might cost you more than winning because of legal fees and all that jazz.
Many companies do that though, like there once was an error for preordering SC2 only costing $5 dollars or something on best buy off the website, but they soon corrected it and refunded everybody the money because they saw that SC2 was going out for a measly 5 bucks.

Companies usually get away with this. If you can't prove it was a bait and switch rather than a mistake, there is nothing you can do.

What did you buy and what was the website?

I think they are allowed to refund you the money as long as they didn't process your transaction and deliver you any goods, kinda like just refusing your purchase, which any retailer can do on grounds of unintentional pricing errors.

this is the most common response when they accidentally undercharge for something and notice: refund your money and cancel the order. i'm sure it's legal as it is so common that by now somebody would have sued to stop it.

Courts will usually not deal with the adequacy of a contract's consideration unless the consideration is grossly inadequate. I think most people would agree that the product is grossly mis-priced. Furthermore, you just admitted that you identified the unilateral mistake on their part and subsequently took advantage of their mistake. Thus, I'd be willing to say that their mistake and refund is completely legal.

He can't, because the thing in question actually costs $2000. There was some sort of website error or glitch that allowed him to put in an order for $45. In this case, the company has every right to deny the order. Similarly to if some rogue employee stickers something in the store for $1 when it costs $100, the company can just refuse to sell it for that price.

@ Enervate - I bought YuGiOh cards from GamingETC.
I know it is an unintentional pricing mistake.
But I feel it is my right for the order to be processed because I paid accordingly.

@Hot_Bid - They updated the price to what it is supposed to be.

Damn, I've read the OP a few times but I just can't understand it fully. But this is how I understand it, you spent $45 for something that is really worth $2000? Then they refunded $45?

If this is the case then I would say maybe you have a cause of action, but it's not worth the hassle. The fact that you knew that this item was worth substantially less than what you paid for would probably play against you. But even assuming that all the facts play in your favor, think of the legal fees you would have to pay to recover damages. I doubt its a worthy investment to pay the money in legal fees to recover a total of $2000 worth in damages.

Wtf of course they're allowed to refund you after such an obvious mistake, and yeah you did something wrong if you tried to buy something worth 2k for 45 bucks just let it go. Letting the "purchase" go through would be like stealing so i don't see why you would even admit to that.

Someone else just pointed out that knowingly trying to get $2k worth of stuff for $45 due to what you KNOW is a glitch is akin to stealing, and I absolutely agree with them. And then the fact that you actually try to justify it and are seeking out legal resolution is just insane to me.

I know that if you are buying a car or something like that in the US, and you make a deal for X dollars, then the place is legally obligated to sell it to you for X dollars and they cannot go back take back tat offer for any reason. This mostly has to do with financing, they cant give you one price, then find out you are paying with cash instead of getting a loan, then take back the deal because due to method of payment.

I have no idea if this would or would not apply to them, its likely in their terms of service that they can cancel orders, in which case they can cancel orders

I wonder why he is hasn't mentioned the product or business at all... makes me wonder if he almost got $2000 worth of blowup dolls or something. Or may he was trying to get $2000 worth of SC2 for $45 from the TL store. (Obviously the numbers don't match that... must be blow up dolls or dildos)
