It's unlikely your ISP will sell you out with only your 1st warning. As long as you stop and don't create any more problems for them you should be fine. It's extremely unlikely your ISP is going to go through your computer and look for stuff you downloaded illegally, they usually get involved when a company contacts them about you filesharing their product. In this case it is EASports that contacted them, it's unlikely anyone will contact them over downloading The Big Lebowski. Pretty sure the issue is settled and they are giving you a warning.

I have downloaded a lot of games from demonoid.com and never got caught. I would stick with demonoid for games when it comes up and just stop downloading games altogether unless you find a private tracker.

It's never a good idea to download new movies/albums from public trackers so I would avoid doing that as well.

umm I'm not really too keen on the legal issues of this but does anyone else think it's a little messed up for his ISP to keep track of what he's downloaded and to report that to a third-party? OP, have you talked to a lawyer about this?

Do other ISPs do this (ie comcast)?

I've been busted for downloading twice, and my ISP has a 3 strike policy, so I've cut out downloading, for the most part.

I was busted for downloading tv shows, both on highly seeded torrents either after they were leaked early (a season 5 episode of The Wire) or the night after they aired (Friday Night Lights). So I assumed that it was reported to my ISP by the respective owners, but the weird thing about it was that you had to click a link on your browser after you deleted the file to restart your service. First time I had clicked it without even really thinking, and it didn't restart my service yet, because it said I hadn't removed the file.

Any way they can know that you haven't deleted a file is an intrusion to your privacy and probably illegal. These people LOVE fighting fire with fire, and should be prosecuted to hell and back... if we lived in a just world.

I've been downloading since 2005 of Isohunt, and I've never received a warning. I have AT&T, and a pretty shitty connection to boot(80 Kb/s download). I mostly download DVD rips, musical albums, and occasionally some PC games.

Update: My father called them and they were pretty much nice about it.

However, they want me to remove any torrent clients I have. Really dumb imo because I use utorrent for legal things as well. But whateva makes them happy and keeps me safe from da law.

Mostly from the result of me being stupid and not having patience to wait for things to come to private sites so i wandered into mininova and shit of the like. Seriously stay away from public trackers if at all possible.

About the deleting infringing material part, its pretty bullshit. They told me to delete the documentary and I didn't. It's not like they are going to send the police to your house and see if you have a fucking movie on your computer or anything. It's all scare tactics.

If anything these letters are worse for them because you just end up getting smarter about downloading and become even more elusive, so ironic...

From the ISP's perspective, they want to keep you as a customer. They also don't want you to get sued because it'll cost them time and money to respond to subpoenas for logs, plus it's bad publicity. If you shift your downloading to private sources, that's a win for the ISPs too.

Calling the ISP and admitting you did something illegal doesn't sound wise to me.
And why can your ISP forward your connection data to other companies without an order from a court order? Are privacy laws really that bad in the US?

My sister got caught for using LimeWire as well. Somehow they came up with being able to fine her roughly $500 per song, and she eventually had to settle for $5000. And I am not trolling. Do not fuck around with this shit.

And, it wasn't the "one person a year", or whatever that garbage was. They also opened lawsuits on 131 other people.

How recent is this? Was she uploading new files or was she using limewire in a university campus line?

I knew someone who got in trouble for this, she had to settle for like 2k. that was like 4 years ago though when it was a bigger issue. it was shocking to see someone you know get hit like that but I guess they are getting more and more aggressive. Kinda surprised they hit you for 1 game though, they usually go for the huge dlers.

Typically, the rights owner will discover someone infringing their copyrights and inform the ISP. The ISP will then figure out who is responsible and tell him/her to delete the infringing material, stop downloading illegally, etc. I don't think any ISPs have coughed up their customers' information without a court order, but I'm also not aware of any privacy laws that would prevent them from doing so. Does Germany have a law that protects the privacy of your IP address, and if so, what recourse would you have if an ISP revealed it?

I wouldn't mess around with it... honestly, computer game publishers have largely hopped onto the Steam bandwagon, and prices come down a lot more quickly than they used to (and it's usually staggered). There's always a weekend sale every now and then, so Dead Space 30 bucks now, could get it for 15-20 bucks during a weekend sale.
