Edit: Today, the 17th of April, the verdict in the Pirate Bay trial was passed and the defendants were found guilty of making 20 song, nine movies and four video games "available" for pirating. The sentence was very harsh at 1 year in prison and 30 million Kronor (~$4m) in damages. The response from the Bay was not very surprising:

So, the dice courts judgement is here. It was lol to read and hear, crazy verdict.
But as in all good movies, the heroes lose in the beginning but have an epic victory in the end anyhow. That's the only thing hollywood ever taught us.

Johan Nilsson, one of the defendants lawyers, said he was very surprised by the verdict and especially the massive amount of damages. He also stated that they will appeal to a higher court.

Personally I think they're going to lose in the second highest court aswell (Hovrätten) and that they will have to bring this to the supreme court so that they can make a legal precedent. The supreme court could potentially have a different view of this matter as the evidence are thin, to say the least, at some points in this case. Only time will tell as this is far from over.

So I searched TL for a topic on this but nothing came up which I found kind of strange considering that many TL:ers (all?) are pirates to some extent. But anyway here's the deal:

On January 31, 2008, Swedish prosecutors filed charges against four of the individuals behind The Pirate Bay, a torrent tracking website, for "promoting other people's infringements of copyright laws" - From Wikipedia

Basically The Pirate Bay is being charged with "Assisting copyright infringement" or something of the sort. They were intially also charged with pirating themselves but those charges were dropped when it was proven that the material the prosecutors had could'nt be linked to the site or the tracker.
The case is the product of the raid the police did three years ago where they seized all the servers and alot of other stuff linked to the site.

This case is extremely big and it will probably take a long time before everything is said in the matter. No matter what side wins the other will appeal to a higher court for sure.
The defendants are the three original creators of the Pirate Bay and a business man with links to the site and they're being sued by some major entertainment companies (Universal, Sierra, Warner Bros, Blizzard, 20th Century Fox, etc, you get the picture). In total they are being sued for $13 million, and the 4 defendants are also potentially facing some prison time (though this is Sweden so they'll probably get like 5 minutes).

From what I've understood the prosecution does'nt really have much of a case and the only thing that has any chance of sticking is the fact that they make alot of money of the ads on the site, which is something even many filesharers have a problem with. There has been some controversy over the amounts they make though, some claim it to be in the millions but they themselves deny that and claims it to be just about enough to pay for bandwidth, servers etc.

In Sweden the trial is big news almost every day and it seems that many people here are rooting for TPB to come out on top which seems pretty likely at the moment considering the fact that the prosecution has already dropped half the charges.

So, dear TL what do you guys think? Charming Johnny Depp pirates or evil Captain Hook pirates

It's weird it even made it to court and I guess it's just a media ploy by the dinosaur companies to show that they are doing something and I guess they dont care that it is pointless. When they raided the servers ect they really believed that they would find pirated software on them. I'd be pretty confused if the piratebay guys are found guilty of anything.

I think that the most important aspect of this case is the legal precedent wich would be set, where they to be punished.

As far as I've been informed, the only way that these people could be convicted, they would be convicted for creating a search engine with which you can find copyrighted material. This legal precedent would therefore mean that google could be classified as illegal.

Although the thing that's most worrying though is that apparently, the prosecuting atourneys haven't actually figured out how torrents work (after a year of investigating) and can't really make criminal charges since they don't know what they're dealing with.

I've heard all this from my well informed friends, but can't give you any confirmation. If I'm wrong, please prove me wrong. I'd just like to say that the important part of this case is how it's been blown up just because it's about filesharing, while at the same time the charges are preposterous and it's being handled by what seems to be a bunch of imbecills.

Actually, today's front page news on one of sweden's biggest newspaper sites is all about that issue.

http://dn.se/kultur-noje/starka-asikter-och-stora-skulder-1.803170

It's in swedish, but to recap: Three of the four defendants are not what you would call wealthy, by any means, and two of them have no registered income, or even huge debts. The last one had money before TPB was started (I belive) so that's not any indication either that TPB is some kind of reliable income source.

Current theory is that if Piratebay goes down, it'll crush every other tracker.

Raynor told TorrentFreak that if The Pirate Bay goes down, many of the other trackers might collapse as well. “If The Pirate Bay goes down the load will automatically shift to others. This is because most of the Pirate Bay swarms also include other trackers. When Pirate Bay goes down it would overload others until they fall also. Meaning even more stress and further casualties. This is likely to end in a BitTorrent meltdown.”

Yeah apparently the companies who buy ad-space on the site are not very reliable and most legit companies avoid dealing with a potentially illegal site so I can't imagine them making that much money of it. One of the founders (Peter Sunde I think) said he had never used any TPB money for himself, and that they often found themselves in debt. This makes the sum they're being sued for pretty damn ridiculous, but I guess it's all about putting the foot down on the filesharing issue. Too bad for them they're stepping in some real trouble when TPB wins and the whole anti-pirating movement gets owned.
