Launched just over three days ago, AZUBU.tv is seen by many in our community as a direct competitor to the firmly-entrenched online video streaming business of Twitch.tv.
A look at the Terms of Service of AZUBU.tv sheds an interesting, and very confusing, light on the situation:
11. Disclosures.
The services are offered by Justin.tv, Inc. dba AZUBU TV, located at: 23 Geary Street, Suite 800, San Francisco, CA 94108 and email: help@azubu.tv. If you are a California resident, you may have this same information emailed to you by sending a letter to the foregoing address with your email address and a request for this information.

There seems to be two logical interpretations of this: Justin.tv, who owns and operates Twitch.tv, does in fact own and operate AZUBU.tv. DBA is a legal term in the United States for "doing business as," something required when operating with a fictious business name.

EDIT: OFFICIAL TWITCH STATEMENT ON THIS MATTER
- The other interpretation is that AZUBU is directly copy-pasting Terms of Service from their competitor without any regard to the transferability of Twitch's terms to their particular service or business model.
This feasibility of this interpretation is fueled by the fact that the entire Terms of Service as listed on AZUBU's website seems disjointed, unorganized, and written with different voices. Can those with more knowledge about this situation comment on the matter? This thread was made in reaction to publicly-available information found on both company's websites.
The implications of the first interpretation aren't as significant, I feel, as the implications of the second: a company directly copy-pasting legal documents so haphazardly.

Wow, either way this looks bad for azubu tv competing with twitch. Either they are owned by the same people who own twitch, or they are lazy/ incompetent enough to strait up copy paste terms of service from their competitor, which does not look good at all for the quality of the company.

Plus, even today, no one knows what the fuck Azubu DOES. It's worth investigating.

I have made a habit of reading legal stuff and considering what I find before I sign up or use a service, it's just good practice to do it.

I think it has to be option 2, I can't see any reason for jtv to open another competing service for any reason what so ever. It just wouldn't make sense.

Up until 2 days ago, Azubu's ToS was just the bottom 4 paragraphs of their current ToS. They're grossly incompetent, and copy-pasted Twitch's ToS and find-replaced 'Twitch.tv' with 'AZUBU.TV'. Pretty much 100% sure of this. If you have an account on Azubu, you should make sure your password is something different from every other site you use, I wouldn't trust their security practices.
Since I'm sure many of you are lazy, the below embedded image tag has now changed your password on Azubu to 'AZUBU' (if you're logged in in the same browser session). You're welcome!

But yeah no one has ever figured out where this money comes from which made me always scared also about all the players they signed. Hopefully they won't lose their home in cca 6 months.

Look at their sites. They are basically all dead and useless and spammed by advertisement bots. They get maybe a few hundred page views.

I checked through their Terms of Service upon release, and none of this was there (only the last paragraph or two). With the insane amount of site vulnerabilities and previous hackings to the page, my thoughts are that this could have been hacked into the site, but that's just speculation.

It might just be some rich guy who likes e-sports a lot. Thats what I personally think. The person clearly doesnt give a shit about making money- just wants to be involved in e-sports.

This seems like one of the most plausible explanations about Azubu. Simply a Korean entity operating from outside of Korea, but with a focus in a heavily Korean business environment. Thus, knowing more about the company's history would be the easiest way to learn about Azubu's main goals. Kind of makes sense why the Korean netizens were skeptical about Azubu when they first popped on to the scene with their allegations of ghost company, etc.

I'm still abashed at the fact people took this "Azubu live platform" seriously.
I mean, if own3d TV proved something, it's that for a sustainable business, you need a healthy DOZEN million dollars, to pay for tech, bandwidth and servers, and salesforce to buy/sell ads to make streams profitable - which so far, only a handful of powerful internet players managed (including twitch).
So far, Azubu: - is a 50K€ german subsidiary of a KR standard web agency - has a mock-up website. I'm sorry but: registering/logging in is hell, it's buggy and not secure, streams have no distinct URLs, and well, THERE HERE IS NO LIVE CONTENT. Everything is marked "offline". And well, you can't start your own stream channel, let alone get revenues from it. - I see no ads on Azubu VODs
So far and for now, Twitch is king out there. Then you have a few small (yet great) websites that offer the same kind of services: MotionCreds.com (hosting ForGG and a few others), CyberGame.tv (mainly russian) and that new hashd.tv website (maybe a few others).
Apart from MotionCreds, which is closely backed by giant VOD provider Dailymotion, I have no idea if the others are able to pay revenues to the streamers...

Can someone with business knowledge comment on whether such a company structure (spread across the USA, Germany and the British Virgin Islands) is common or not? It might just be a normal way to save taxes and still have a good jurisdiction (or something like that).

Companies copy other companies legal disclaimers all the time. It's usually done for the reasons of being inspired by another similar companies legal document. You could technically sue another company for stealing your disclaimer but that rarely happens. Azubu will hire a lawyer and they will have their own disclaimer. Don't worry.

I doubt they'll have to hire a lawyer for this little. They'll just rewrite part of it, copying a few other websites and that's all there will be to it. Unless Justin/Twitch wants to sue them badly, and again, I seriously doubt it. It's Germany, not the US!
