No need to watch the VOD again. I understand what he told dela Rionda and I understand what he told West. I understand they are both evidence. The problem for the prosecution, and thus their argument that the lack of evidence is itself evidence, is that there is evidence, as testified to under cross-examination by the ME, that he was only looking for injury or disease, and thus didn't note or photograph the hands. He also said under direct, cross, and every chance he got, that he doesn't remember a damned thing about this specific case. Given this testimony, the state can't reasonably argue that since they didn't preserve evidence of what the hands looked like, that there was no blood. That very point will be driven home in closing argument, I promise you. | ||
