XFX Warranty Legal??

Hey guys
Essentially what has happened is that I have just now realized that I was supposed to register my video card (XFX 5850) online with XFX. I did some searching to find out if they would honor the warranty, should I need it, and I have come across numerous sources saying they could not help. My video card is fine right now but I want it registered so that I can take advantage of their DOUBLE LIFETIME WARRANTY should I ever need it. In my research I came across this:

SUBCHAPTER G - RULES, REGULATIONS, STATEMENTS AND INTERPRETATIONS UNDER THE MAGNUSON - MOSS WARRANTY ACT

PART 700 - INTERPRETATIONS OF MAGNUSON - MOSS WARRANTY ACT

700.7 - Use of warranty registration cards.

(a) Under section 104(b)(1) of the Act a warrantor offering a full warranty may not impose on consumers any duty other than notification of a defect as a condition of securing remedy of the defect or malfunction, unless such additional duty can be demonstrated by the warrantor to be reasonable. Warrantors have in the past stipulated the return of a warranty registration or similar card. By warranty registration card the Commission means a card which must be returned by the consumer shortly after purchase of the product and which is stipulated or implied in the warranty to be a condition precedent to warranty coverage and performance.

(b) A requirement that the consumer return a warranty registration card or a similar notice as a condition of performance under a full warranty is an unreasonable duty. Thus, a provision such as, This warranty is void unless the warranty registration card is returned to the warrantor is not permissible in a full warranty, nor is it permissible to imply such a condition in a full warranty.

(c) This does not prohibit the use of such registration cards where a warrantor suggests use of the card as one possible means of proof of the date the product was purchased. For example, it is permissible to provide in a full warranty that a consumer may fill out and return a card to place on file proof of the date the product was purchased. Any such suggestion to the consumer must include notice that failure to return the card will not affect rights under the warranty, so long as the consumer can show in a reasonable manner the date the product was purchased. Nor does this interpretation prohibit a seller from obtaining from purchasers at the time of sale information requested by the warrantor.

Can you summarize what the warranty act says? I can't understand some of it. I just did a warranty exchange with my XFX 5850 last month, so I'm curious to know if this would affect me.

This act only applies to full warranty, XFX provides one year of full warranty for their GPUs.

Double lifetime warranty is limited and is only available to those who register their purchase within 30 days.

So you're outta luck )=

for me XFX had one of the best experiences ever

my 8800 gt went to shit, but like you i forgot to register (who does that lol) so i just lied and said i bought it 30 days ago or whatever the limit was. They got me a new one within 2 days. they had great customer support compared to say, Acer which is one of the worst companies ever lol

oh and on top of that they actually have people that speak clear good english, not like most support lines where the guy is halfway around the world and speaks barely understandable english

I card I bought from EVGA (I know different company) that I didn't register at all and it died bout 4 years after. I called them and they still honored it so it's worth contacting the manufacturer at any rate.

Haha...

You should definitely lie. If the company can't be bothered to figure out whether people are lying or not, then you should lie. They could have a pretty foolproof system to catch people I would think, so it must not matter that much to them.

Say that you've only had the card for a couple weeks. XFX is a nice company and will replace it, although their RMA process can take awhile.

1) Companies like XFX make 90% of their profit on customer service and such, so it's in their interest to keep you happy (unlike telephony companies, arg).

2) The law states that a company cannot require you to opt-in to a warranty. They can require you to fill out a card as a proof-of-purchase date thing, but if you have a receipt (brick & mortar) or you have a copy of the invoice and a copy of the tracking slip, or the tracking label off the package (online retail, eg Newegg), you still don't have to fill out a warranty card.

They would be honoring the one year warranty. They aren't under any obligation to honor their double lifetime warranty if you didn't register the card..

Im just bummed because I bought the card because of this really good warranty, but it didnt say anywhere except on their website that i needed to register.
