Looks like the standard is that all evidence must be view in the light most favorable to the state. The motion will be denied on that standard. EDIT: O'Mara is arguing a very nuanced point about circumstantial versus direct evidence and rebutting a claim of self-defense and he seems to be relying upon case law that supports his position. He may have a better basis for the motion than I thought. We'll see though. | ||
