That right there, gives MLG the right to the image that was taken at their Event.

Did he have a press badge?

Did he have a press badge? I would imagine the terms for buying tickets to MLG say something similar.

What makes you think he had one of these badges? As I understand he was just a spectator who nabbed a good picture of sheth.

The press badge is just the first thing that came to mind. I would have to find my old MLG spectator pass to double check, but I am fairly certain (read 85%) that even the spectator pass had a stipulation similar to the above one in it.

That would be ridiculous. Pretty sure there would be a backlash if ANY photo/video taken by ANY spectator belongs to MLG.
And MLG clearly admitted fault in this matter, so that definitely isn't the case. Double check stuff before spewing nonsense bro

So we can be 85% that the guy made a fool of himself but MLG was very smart at handling the "problem" without making him and them look bad, impressive.

I am not a lawyer, but this redditor seem to know what he's talking about:
bobartig 22 points 3 hours ago make commercial use of any visual or audio media of any kind from this event Arguing that "any visual or audio media of any kind from this event is inclusive of photos taken by the OP is a HUGE stretch. The operative phrase "from this event" cannot be inclusive of photos taken by OP unless the above phrase is construed to constitute an unlimited license from OP to MLG for the photos taken - in other words - you need to argue that the above phrase constitutes a separate contract between OP and MLG. Highly, highly, highly unlikely. The holder grants permission to MLG... This only grants permission to MLG for likeness rights (Right of Publicity), but would not clear copyright issues like OP is arguing. http://www.reddit.com/r/starcraft/comments/q6wvi/mlg_copyright_infringement/

Can you show me where MLG admitted fault in this? I know that they resolved the situation, but that was most likely good PR on their part.
Spewing nonsense, Isn't that just what everybody does though? Just like you did when you provided zero sources about MLG admitting it was their fault. Without itsjustatank coming out and saying what was discussed between MLG_Adam and himself then we really won't know. My guess goes with he had no legal standing, MLG_Adam let him know and he was like 'Oh shit you're right Adam, sorry." But MLG being the good guys they are won't put this guy under the bus like he did to them.

That is enough to shut me up. Thanks

Hope this won't scare you off from upcoming events. Which BarCraft will you be covering/attending tomorrow? Tomorrow? There's a Barcraft tomorrow? WHERE! We had a very successful one last night in San Diego, great turnout. Irvine Anaheim and K-town I believe. San Diego only does Saturdays atm right?
Usually Saturdays, yes.

EDIT: Same time post when someone realized they were wrong. I shall remove my mean comment

I'm not sure how I would have reacted in the situation so that is all I'm able to say about it. The picture is a great shot too, non the less.
Welcome to Team Liquid. You may not agree with American copyright law, or how I've handled this situation, but this doesn't allow you act this way, even if you are only trolling. Now that you've recognized your error, I'd advise you to cease and desist continuing to host that image on your Flickr account.
Or you can just wait for my already submitted DMCA Takedown notice to take effect and have it done for you.

I wish MLG were this responsive to other community complaints =/
Glad to hear that the issue got resolved though, the last thing we need is copyright issues in eSports.

The thread earlier was embarassing

Good job MLG for responding to this so quickly. They're certainly a very reasonable organization. Keep up the good photography, itsjustatank!

You know, a normal person would be like "Hey! MLG is using my picture of Sheth, cool!"
But instead you had to get butthurt and act like they are infringing on your rights and make a whine thread trying to insult mlg instead of just contacting them privately.

You're kidding right? He was pretty polite about it. There isn't a very clear way to get in touch with MLG about an issue like this and so he made a post on a prestigious community website where MLG staffers and people in the know post/read.
IP rights are very serious. MLG is using his IP to make money and not giving him credit. A photo like this one (ie: a very good candid) has a real value. Don't come into his blog and be a douche about an issue that the community needs to deal with to continue growing.

They were infringing on his rights, lol.
In my experience (cough gosucoachingrefund cough), making a stink about a situation TL is the best way to get the matter resolved quickly. Ideally this shouldn't be the case, and ideally the op could have contacted MLG privately first, but he was certainly under no obligation to do so after having his picture used. Glad it was resolved for you though

Yeah, I'll admit to being a bit hot-headed when making that original post. As I've said, I didn't really know who to contact and where to turn, so I turned to the forum that I've made my home for the past year or so.
To be clear, this issue is completely and satisfactorily resolved as far as MLG and I are concerned. Posting this thread was something both parties mutually agreed upon so that people know that the issue is resolved, because the original thread is closed.
