At the same time though, we can't let these instances of police brutality push us to adopt policies that might hinder or dissuade cops from using necessary force in legitimate situations. We need to realize that for every cop that acts in this manner there are scores who do not. The job is difficult and good cops will sometimes make mistakes in the heat of the situation. For example The student in this video may be within the law, but he's deliberately bating the cop into looking bad and is more or less being the idiot. Walking around with a gun out is a legitimate cause for concern. The cop may not be within the letter of the law, but he is in the spirit of the law by protecting the community from a possible danger. To be clear, I'm not trying to defend the cop in the OP video at all. I just want to remind people to keep the bigger picture in mind, especially with all the 'bad cop' scenarios in the news. | ||

If people of Portland, Maine don't like the law, they can try to change it or move somewhere else. It's legal to open carry there. What's the bait? The logic of "spirit of the law by protecting the community" is what's got us with stop and frisk in NYC, which is unconstitutional. We're governed by the rule of law. Don't like the law? You're welcome to go to another country. Cops can't demand an ID without reasonable cause of suspicion. Cops can't detain someone without suspicion of criminal activity (which must be explicitly stated) Cops can't stop someone if the sole reason for stopping is that someone is legally carrying a gun Cops can't take your gun away from you without suspicion of a committed crime (crime must be explicitly stated by cop) The student knows the law. I would hope law student would know the law. But most people, including the cop, don't know the law or don't like following the law. | ||

I mean, sure he should maybe brush up on his knowledge of the law, but that's small fries. What if that guy was actually really high on some drug, angry, and about to go shoot up a bank or walk into a school. Are you really saying having a cop pull up in that situation shouldn't happen? | ||

I don't get why police don't have the ability to card someone there.... that's not exactly trampling on human rights. | ||

And in those states cops can make up a reason to ID someone because the basis is "reasonable suspicion." Every state has different degrees of forced ID laws. Some states, like Nevada, just require you to say your name, while others require an actual card ID. Maine (location of where the video was taken) doesn't have forced ID. | ||
